2022 Wild Corn Waiver
ASSUMPTION OF RISK, RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT
THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS
The person who is participating in and/or taking part of any volunteer activity related to the WILD CORN SHINDIG! (hereinafter “EVENT”), with Granite Backcountry Alliance (hereinafter “GBA”), shall be referred to hereinafter as "PARTICIPANT". “THE UNDERSIGNED" means only the PARTICIPANT when the PARTICIPANT is age l8 or older OR it means both the PARTICIPANT and the PARTICIPANT's parent or legal guardian when the PARTICIPANT is under the age of 18. THE UNDERSIGNED agree and understand that assisting with or preparing for the EVENT, taking part in the EVENT and/or any other uses of the facilities associated with the EVENT can be HAZARDOUS AND INVOLVES THE RISK OF PHYSICAL INJURY OR DEATH. THE UNDERSIGNED understand and acknowledge that the EVENT may involve strenuous outdoor activity on King Pine Resort and/or its environs and, ASSUMES THE FOLLOWING RISKS:
THE UNDERSIGNED agree and understand that risks associated with the EVENT include, but are not limited to: ski or snowboard equipment malfunction; surface conditions on both snow, water and ice; marked and unmarked obstacles both on land/snow and water/ice; rugged mountainous terrain; slick or uneven terrain, riding and walking surfaces, surfaces covered with ice and snow and mud or pavement; strenuous activity; high elevation; sharing facilities and EVENT venues with people directly involved and/or indirectly involved in EVENT.
PARTICIPANT understands and acknowledges he/she has been informed and understands all rules and regulations of participation in the EVENT. PARTICIPANT is responsible for reading, understanding and complying with all signage and instructions associated with the EVENT. PARTICIPANT recognizes that he/she must have the physical dexterity and knowledge sufficient to participate in the EVENT, and assumes any and all risks associated with the EVENT. RECOGNIZING ALL THE RISKS, PARTICIPANT VOLUNTARILY CHOOSES TO TAKE PART IN THE EVENT.
In consideration of allowing the PARTICIPANT to participate in the EVENT, THE UNDERSIGNED hereby agree to ASSUME ALL RISKS associated with the PARTICIPANT's participation in the EVENT. Additionally, THE UNDERSIGNED agree to HOLD HARMLESS, RELEASE, DEFEND, AND INDEMNIFY, GBA, its Board of Directors and affiliated organizations and companies, and their insurance carriers, their respective agents, employees, representatives, assignees, officers, directors, shareholders and Alpine Resources Corporation, owner of King Pine Resort and all shareholders, employees, agents or assigns (each hereinafter a "RELEASED PARTY") for ANY AND ALL LIABILITY and/or claims for injury or death to persons or damage to property arising from the PARTICIPANT's participation in the EVENT, including those claims based on any RELEASED PARTY's alleged or actual NEGLIGENCE OR BREACH OF any express or implied WARRANTY. By signing this release, THE UNNDERSIGNED agree that they are releasing any right to make a claim or file a lawsuit against any Released Party.
THE UNDERSIGNED AGREE TO DEFEND AND INDEMNIFY each RELEASED PARTY for any and all claims of THE UNDERSIGNED and/or a third party arising from the PARTICIPANT's participation in the EVENT.
I hereby consent to receive medical treatment which may be deemed necessary in the event of any illness, accident or injury or medical emergency resulting from or in connection with my participation in the EVENT and understand that I am solely responsible for all costs related to such medical treatment, medical transportation and/or evacuation.
I hereby grant GBA, without limitation, the right to use my name and likeness in connection with the EVENT for any publicity without further compensation or permission.
RELEASE AND WAIVER OF LIABILITY RELATING TO COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious. The state of medical knowledge continues to evolve, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and the vaccine for COVID-19 is currently being administered to specific groups of people. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and death.
GRANITE BACKCOUNTRY ALLIANCE (“GBA”) cannot prevent you or your child(ren) from becoming exposed to, contracting, or spreading COVID-19 while utilizing and/or engaging in GBA’s services or premises (in which it manages). It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize and/or engage in GBA’s services and/or enter onto GBA’s premises it manages you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.
ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID 19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to utilize and/or engage in GBA’s services as a volunteer or participant and enter GBA’s premises in which it manages or event spaces. These services are of such value to me and/or to my children, that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize and/or engage GBA’s services, events and premises in person.
WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against GBA and its board of directors, officers, managers, officials, trustees, partners, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing and/or engaging in GBA’s services, events and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.
CHOICE OF LAW: I understand and agree that the law of the State of New Hampshire will apply to this Release.
